This topic is important for the nation and the Indonesian government since at least it is associated with 3 (three) regulations: 1) The 1966 of ILO / UNESCO Recommendation Conference about the Status of Teachers; 2) Law No. 14 of 2004 about Teachers and Lecturers; 3) Chapter X A in the 1945 Constitution (UUD 1945) about Human Rights. These three regulation are not only dealing with the government's constitutional obligations, the government authority of the international community point of view but also about the life of the teacher; it means if it does not fulfill, then teachers will not be able to meet their basic needs for carrying out the noble task of educating the nation.
The existence of temporary staffs working at schools, especially teachers, is actually originated from fundamental and urgent factors. Those are categorized as basic needs for it relates to services to human rights. In addition, it is also the most important part of the existence of duties and functions of the schools. The need is also an urgent necessity because if it does not immediately available, the learning process will be disrupted and very likely that the school will be referred to protests by the community. By the same tasks as civil servants, temporary teachers obtain an extremely inadequate compensation with no standard. Hoping can be appointed as civil servants make them have strong will to stay working for years. Unfortunately, the government is inconsistent and not seriously applying Law No. 43 of 1999 article 2 paragraph (3) as an alteration of Law No. 8 of 1974 on the Principles of Personnel. In fact, government issued Government Regulation No. 43 of 2007 which is not realistic. It makes the regional officials, including the principals, break it intentionally. The amount of temporary staffs today, especially teachers, is around hundreds of thousands. Although their number is not surely stated, their existence provides effective public services in the educational process at school.
This article is about to consider a new management as a solution prepared based on observation which is in line with Law No. 5 of 2014 about State Civil Apparatus.
